Guidelines for In-person Proceedings:
Starting in May 2021, the Court will begin conducting oral arguments and other proceedings in person on a case-by-case basis. While the Judge of the Georgia State-wide Business Court is fully vaccinated, he will nonetheless wear a mask until seated on the bench. All other persons in the courtroom will be expected to wear masks covering their nose and mouth, except that counsel may elect to remove their masks while speaking from counsel tables. (The Court will consider requests from counsel to use the lectern, provided such requests are made in advance of a hearing to allow the Court sufficient time to implement its safety protocols.) The courtroom will be sanitized before and after each proceeding with hand sanitizer, disposable masks, and disinfectant wipes made available to counsel throughout. Prior to such proceedings, the Court will also provide counsel with written guidance detailing the Court’s health and safety protocols and other information relating to their visit.
While the courtroom gallery normally accommodates approximately 40 people, with social distancing, seating will be available for up to eight people. Co-counsel, parties, interested persons, and media representatives who attend hearings will be expected to follow COVID-19 guidelines, wear masks covering their nose and mouth, and maintain social distancing as indicated on posted signs. All in-person proceedings will be broadcast live on the Court’s website, which can be found here: https://www.georgiabusinesscourt.com/live/. Virtual proceedings will continue to be live streamed as well.
The Court’s health and safety protocols will be reassessed after each proceeding, and updates to such protocols will be posted here, as well as in the Court’s written guidance, as appropriate.
